In particular, if you are MotherIndiaCard customer and there is any conflict between these terms and conditions on the one hand, and the terms and conditions of the Customer Service Agreement on the other, the terms and conditions of the Customer Service Agreement shall prevail.

(1) Unauthorized Access and Notification

You agree that you will only access the Website in accordance with (i) these terms and conditions and (ii) all applicable laws and regulations of any applicable jurisdiction. You are obligated to keep your password strictly confidential in order to prevent any unauthorized use of your account. You acknowledge and accept that considering the nature of the Services, changes of your password will be required from time to time in order to avoid misuse and to maintain the secrecy of your account information. We will not be responsible for any wrongful or unauthorized use of your password or account under any circumstances. If you believe that there has been any breach of security of your password or account (such as the disclosure, theft or unauthorized use of your name, password or account information), you must notify us immediately.

Loaning your name, password or account to others, connecting to the Website through a system used by multiple persons, your group use of names, passwords and accounts, and accessing the Website through more than one modem or broadband communication line are explicitly prohibited. If you have multiple accounts, then you shall be limited to one log-in session per account at any time. Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network.

Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks.

Forgery or obscuring any identification, hostnames, IP addresses or message header information in any data.

Harassing or threatening transmissions through systems or networks.

Probing for means of gaining unauthorized access to systems or networks.

Introducing or causing to be introduced any computer contaminant or viruses into systems or networks.

Introducing or causing to introduced any pornographic material into systems or networks.

(3) Age Limit

You represent to us that you are 18 years of age or older.

(4) Internet Telephony

Internet telephony is not permitted in connection with your use of the Website.

(5) Force Majeure

We shall not be liable, or deemed to be in default of these terms and conditions, for any delay, failure or interruption relating to your access of the Website resulting directly or indirectly from acts of God, civil or military authority, acts of public enemies, wars, riots, civil disturbances, insurrections, accidents, explosions, earthquakes, floods, natural disasters, strikes, labor disputes, shortages of suitable parts, materials, labor or transportation or any cause beyond our reasonable control.

All content related to MotherIndiaCard's activities through the Website, such as text, graphics, logos, button icons, images, audio clips and software, is the exclusive property of MotherIndiaCard or its affiliates or licensors and is protected by applicable law concerning the protection and preservation of intellectual property rights and applicable international treaties governing intellectual property. The collection, arrangement and assembly of all content on the Website are the exclusive property of MotherIndiaCard and are protected by applicable laws. All software used on this Website is the property of MotherIndiaCard or its suppliers and is protected by U.S. or international copyright laws. These terms and conditions shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its choice of law rules.

In the event any provision of these terms and conditions is determined by a court of competent jurisdiction to be invalid, illegal or otherwise unenforceable, such provision shall be deemed to have been deleted from these terms and conditions, while the remaining provisions shall remain in full force and effect. MotherIndiaCard's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of these terms and conditions.

(19) Arbitration

Any controversy or claim arising out of or relating to these terms and conditions shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association (“AAA”) at the office in Somerset, New Jersey. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party.

VIOLATION OF ANY OF THESE TERMS AND CONDITIONS MAY RESULT IN IMMEDIATE TERMINATION OF THE PROVISION OF THE SERVICES TO YOU.

If MotherIndiaCard denies you access to the Services due to such violation, (A) you shall have no right (i) to access through the Website to any materials stored by you on the Internet, (ii) to obtain any credit otherwise due to you (and such credit shall be forfeited), (iii) to access third party services, merchandise or information on the Internet through the Website or the Services, and (B) MotherIndiaCard shall have no responsibility to notify any third-party providers of services, merchandise or information to you nor any responsibility for any consequences resulting from such lack of notification.
